Waste compliance
All waste generators and waste disposal service providers need to be compliant with our Integrated Waste Management By-law. If you are found to be contravening the by-law or do not have a waste management plan in place, the City will issue a compliance notice.
Waste management plans
If you are a commercial entity producing waste - whether industrial or general, hazardous or medical, permanently or for an event - you need to have a formal integrated waste management plan (IWMP) in place. The City requests these regularly.

Waste compliance notices
What is a waste compliance notice?
A waste compliance notice is a written notice issued by the Waste Management Officer to any person contravening the
Integrated Waste Management By-law.
It will state:
- which provisions or conditions have been contravened;
- what action is required in order to comply;
- the period in which this corrective action must be done.
Who can be served with a waste compliance notice?
Compliance notices can be served on any of the following:
Any person who committed or permitted the contravention;
The generator of the waste;
The owner of the land or premises;
The person in control of the location at the time of the contravention; or
Any person with a right to use the land or premises when the contravention is observed.
Please note
Compliance notices are also served on waste generators if hazardous or priority waste endangers any person or property.
Fines for non-compliance
Some offences will result in fines, but not all. The
Integrated Waste Management By-law has given the courts several options, including a prison sentence which means the waste generator and/or owner could be saddled with a criminal record.
If the person responsible for contravening the by-law receives a written compliance notice, they will have to stop operations and close shop until appropriate steps are taken to dispose of the waste. Anyone who ignores a compliance notice issued by the
Waste Management Officer is guilty of an offence and faces criminal prosecution.
Should anyone fail to comply with directions given in a compliance notice, the Waste Management Officer can arrange to clean up, remove and dispose of waste lawfully and to rehabilitate the site at which the waste has been illegally dumped or stored. The Waste Management Officer will then recover all costs from those individuals whose legal responsibility it was in the first place.
